1. ACCEPTANCE OF TERMS
By placing an order with Nicholas Nichols Knives you agree to be bound by these Terms of Service. Please read these terms carefully before making a purchase. If you do not agree to these terms, do not place an order.
2. PRODUCT INFORMATION
2.1 Custom Knives
Nicholas Nichols Knives produces high-quality, handcrafted custom knives. Each knife is individually made and may have slight variations from photographs or descriptions due to the handmade nature of our products. These variations do not constitute defects.
2.2 Materials and Specifications
We strive to accurately represent all materials, specifications, and dimensions. However, as a custom shop, minor variations in materials, patterns (especially damascus or other pattern-welded steels), and handle materials are inherent to handcrafted products.
2.3 Age Restrictions
You must be at least of legal age to purchase from Nicholas Nichols Knives. By placing an order, you confirm that you are of legal age to purchase knives in your jurisdiction.
3. ORDERS AND PRICING
3.1 Order Acceptance
All orders are subject to acceptance by Nicholas Nichols Knives. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
3.2 Pricing
All prices are listed in U.S. Dollars and are subject to change without notice. The price charged will be the price in effect at the time your order is placed, provided payment is received.
3.3 Payment
Full payment is required before production begins unless otherwise specified in a custom order agreement. We accept major credit cards, PayPal, and other payment methods as indicated on our website.
3.4 Custom Orders
Custom orders may require a non-refundable deposit. The deposit amount and payment schedule will be outlined in your custom order agreement. Custom orders are subject to additional terms as specified in the custom order agreement.
4. PRODUCTION AND DELIVERY
4.1 Production Time
Production times are estimates and not guarantees. Handcrafted knives require time and attention to detail. We will make every reasonable effort to complete your order within the estimated timeframe, but delays may occur due to material availability, equipment issues, or other unforeseen circumstances.
4.2 Shipping
Shipping times are estimates and begin after production is complete. Nicholas Nichols Knives is not responsible for delays caused by shipping carriers. Customers are responsible for all shipping costs unless otherwise stated.
4.3 Risk of Loss
Risk of loss and title for items purchased pass to you upon delivery to the shipping carrier.
4.4 International Orders
International customers are responsible for all customs duties, taxes, and fees. We are not responsible for delays or issues caused by customs. By ordering internationally, you confirm that the knife(s) ordered are legal to import and possess in your country.
5. RETURNS AND EXCHANGES
5.1 Custom Orders
Due to the custom, handcrafted nature of our products, custom orders are final and non-refundable once production has begun.
5.2 Stock Items
Stock items (non-custom knives) may be returned within 7 days of delivery, provided:
- The knife is unused and in original condition
- All original packaging and materials are included
- Customer pays return shipping costs
- A 15% restocking fee applies
5.3 Defects and Warranty Issues
Returns or exchanges for defective products or warranty claims are handled separately under Section 6 (Warranty).
6. LIMITED WARRANTY
6.1 Warranty Coverage
Nicholas Nichols Knives warrants each knife to be free from defects in materials and workmanship for a period of one (1) year from the date of purchase. This warranty covers:
- Manufacturing defects in materials
- Workmanship issues present at time of purchase
- Structural failures under normal use
6.2 Warranty Exclusions
This warranty does NOT cover:
- Normal wear and tear
- Damage from misuse, abuse, or neglect
- Modifications or repairs made by anyone other than Nicholas Nichols Knives
- Sharpening or edge damage
- Corrosion or rust (proper maintenance is customer's responsibility)
- Damage from improper storage
- Damage during shipping (unless purchased with shipping insurance)
- Loss or theft
6.3 Warranty Claims
To make a warranty claim, contact us with photographs and a description of the issue. If approved, you must return the knife at your expense. We will repair or replace the knife at our discretion and return it to you at our expense.
6.4 Limitation of Liability
This warranty is in lieu of all other warranties, express or implied. Our liability is limited to repair or replacement of the knife. We are not liable for any incidental, consequential, or special damages.
7. PROPER USE AND SAFETY
7.1 Intended Use
Nicholas Nichols Knives are tools designed for cutting tasks. Customers are responsible for using knives safely and appropriately. Knives are not toys and should be kept away from children.
7.2 Assumption of Risk
By purchasing a knife, you acknowledge that knives are inherently dangerous tools. You assume all risk of injury or damage resulting from possession and use of our products.
7.3 Maintenance
Proper care and maintenance are essential for knife longevity. Clean and dry your knife after each use. Apply a light coat of oil to the blade to prevent corrosion. Do not put your knife in the dishwasher.
8. LEGAL COMPLIANCE
8.1 Customer Responsibility
It is the customer's responsibility to know and comply with all federal, state, and local laws regarding the purchase, possession, carry, and use of knives. Laws vary by jurisdiction, and some locations prohibit certain types of knives.
8.2 Prohibited Sales
We do not knowingly ship to jurisdictions where our products are prohibited. By placing an order, you represent and warrant that:
- You are legally permitted to purchase and possess the knife(s) ordered
- The knife(s) will be used in a lawful manner
- You will comply with all applicable laws
8.3 Indemnification
You agree to indemnify and hold harmless Nicholas Nichols Knives from any claims, damages, or expenses arising from your violation of any laws or these Terms of Service.
9. INTELLECTUAL PROPERTY
9.1 Trademarks and Copyrights
All content on our website, including designs, logos, photographs, and text, is the property of Nicholas Nichols Knives and is protected by copyright and trademark laws.
9.2 Product Designs
Knife designs and maker's marks are proprietary to Nicholas Nichols Knives. Reproduction or imitation of our designs is prohibited.
10. PRIVACY
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Nicholas Nichols Knives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use our products
- Any unauthorized access to or use of our servers or personal information
- Any interruption or cessation of our services
- Any bugs, viruses, or similar items transmitted by third parties
- Any errors or omissions in content or products
12. DISPUTE RESOLUTION
12.1 Governing Law

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Service shall otherwise remain in full force and effect.
